RENTAL AGREEMENT

 

TERMS & CONDITIONS

 

These Terms & Conditions form part of your Rental Agreement. They outline your responsibilities and our policies. Please note: the signed Rental Agreement provided in-office governs in the event of any difference.

 

VEHICLE

The Vehicle remains the property of Exuma Automotive Rentals. It includes tires, tools, accessories, keys, and documents, and is delivered in good condition.
•    Unauthorized repairs are not covered under the Vehicle Liability Damage Waiver (VLDW).
•    Any attempted transfer of ownership is void and will be reported to the Royal Bahamas Police Department.
•    NO WARRANTIES are provided regarding condition, merchantability, or fitness for purpose.
•    The Company is not liable for indirect, special, or consequential damages.

 

WHO MAY DRIVE – AUTHORIZED DRIVER(S)

•    Drivers must be 25 years of age or older with a valid physical license (digital copies not accepted).
•    Only drivers approved and signed on the Rental Agreement may drive.
•    Allowing a driver under 25 voids all coverage and the renter is fully financially responsible.

 

VEHICLE RETURNS

•    Return the Vehicle at the agreed location, date, and time.
•    Extensions require a new signed agreement and are subject to availability.
•    Late returns without approval may void coverage and be reported as stolen property.
•    Renter is liable for all associated losses, fees, and damages.

 

VEHICLE REPOSSESSION

The Company may repossess the Vehicle without notice and at renter’s expense if:
•    It is illegally parked, abandoned, or past due date.
•    It is used in violation of law or this Agreement.

 

PROHIBITED USES

The Vehicle may NOT be used:
•    By unauthorized drivers
•    Under the influence of alcohol, drugs, or intoxicants
•    For illegal purposes
•    With false information provided
•    For reckless, abusive, or careless driving
•    To carry passengers or goods for hire
•    For towing, pushing, racing, contests, or training
•    On unpaved/off-road surfaces

If used in a prohibited manner, this Agreement is void. The renter is fully liable for all damages, loss of use, fees, and legal costs. VLDW coverage is also void.

 

VEHICLE DATA

•    Renter is responsible for erasing personal data (e.g., Bluetooth) before return.
•    If the Vehicle is reported stolen, telematics data may be requested.

 

PAYMENT

•    Minimum charge: 1 day (24 hours).
•    Renter agrees to pay:
•    Rental charges, deposits, late fees, taxes, and other fees
•    All damages unless VLDW is accepted and terms are followed
•    Collection/recovery costs including attorney’s fees
•    All fines and penalties
•    Credit card authorization: up to rental cost + BSD $1,000.00.
•    Alternative payment methods require written consent 48–72 hours before pickup/drop-off.
•    All charges are subject to final audit and renter authorizes adjustments to their card.

 

 RESPONSIBILITY FOR LOSS OR DAMAGE (VLDW)

•    Renter is responsible for all damage/theft, including towing, storage, and admin charges.
•    If VLDW is accepted, liability is reduced to BSD $1,000.00, provided terms are followed.
•    Misuse or prohibited use voids VLDW.
•    Declining VLDW means deposit is forfeited if damaged/stolen.
•    If stolen and not recovered in 30 days → renter pays fair market value.

 

DEDUCTIBLE PROTECTION (DP)

•    If VLDW is accepted, renter’s maximum liability is BSD $1,000.00 (if terms complied with).

 

ROADSIDE PLUS (RSP)

•    Included if VLDW is accepted: towing (non-accident), flat tires, lockout, jumpstarts.
•    If VLDW is declined, services are charged separately.
•    VLDW void if Vehicle was misused (see Section 5).

 

FUEL

•    Return with the same fuel level unless prepaid fuel was purchased.
•    Shortages billed at USD $20.00 per gallon.
•    No refunds for excess fuel.

 

TIRES

•    Renter pays for all tire damage.
•    Tire coverage only if VLDW was purchased.

 

SMOKING & EXCESSIVE DIRT

•    No smoking.
•    Cleaning fees apply for smoking, odors, mud, sand, or pet hair.
•    Fees determined at Company’s discretion.

 

LIABILITY / SELF-INSURANCE

•    Renter must maintain personal insurance meeting Bahamian law.
•    Exuma Automotive Rentals provides no liability coverage.
•    All claims, damages, and lawsuits are renter’s sole responsibility.

 

ACCIDENT, THEFT & CLAIMS REPORTING

•    Immediately call Royal Bahamas Police (911) and obtain an official report.
•    Report to Company during office hours at 1-242-828-4087.
•    Failure to obtain police report may make renter liable for all damages.
•    Renter must cooperate with investigations and claims.

 

RESPONSIBILITY FOR PERSONAL PROPERTY

The Company is not responsible for renter’s or others’ property left in Vehicle or on premises. Renter assumes full responsibility for such claims.

 

FINES & PENALTIES

Renter pays all fines and penalties (parking, traffic, tolls). Must indemnify Company from claims/costs.

 

PROCESSING OF RENTER DATA

•    Company collects personal information to process rentals.
•    Data may be used for reservations, rentals, and marketing.
•    Renters may request access, corrections, or deletion.
•    Data handled per Bahamian law; may be disclosed when legally required.

 

GENERAL PROVISIONS

•    Unauthorized repairs not reimbursed.
•    Authorized repairs reimbursed with valid receipts from licensed dealer.
•    Renter must follow seatbelt/child restraint laws.
•    Authorized Drivers are not Company employees.
•    No rights waived except in signed writing by Company.

 

LAW APPLICABLE

•    Governed exclusively by Bahamian law.
•    Disputes submitted to courts of The Bahamas.
•    Company may initiate legal action in any competent jurisdiction.
